Terms and conditions

1. Parties and application
These terms apply when a consumer purchases a Hjerterum Family subscription from the company stated above. The subscription must be purchased by a person aged 18 or over. Child profiles can only be created and administered as part of a family created by an adult.
The version of the terms accepted by the customer at the time of purchase forms part of the agreement. Mandatory Danish and EU consumer protection rules always take precedence over these terms.
2. Hjerterum Family
Hjerterum is a digital family app for tasks, positive habits, Brain Break, hearts, rewards, shared goals and family overview. The current features, number of included family members and price of additional members are shown on the pricing page and in the order summary before payment.
Hjerterum is supplied as a web app and can be installed as a PWA on supported devices. The customer is responsible for internet access, an up-to-date browser and a compatible device.
3. Trial and access
When Hjerterum offers a free trial, its duration and the account types covered are clearly stated during registration. A trial does not require a payment card and does not trigger automatic payment.
The trial does not automatically become a paid subscription. A paid subscription is only created when a responsible adult actively selects a plan and approves an order that includes an obligation to pay. Otherwise, the account becomes inactive when the trial ends. Data and profiles are retained, but normal features are only reopened after an approved payment. The responsible adult can still log in to renew, export data or delete the account.
4. Prices and subscription types
Prices for Danish consumers are displayed in Danish kroner and include VAT. The total price, payment period, any additional members, discounts and minimum price during any commitment period are clearly shown before ordering.
Hjerterum may offer:
- monthly subscriptions paid one month at a time,
- annual subscriptions prepaid for 12 months, and
- time-limited introductory offers, including offers prepaid for up to 24 months.
An offer does not change the customer’s mandatory rights to withdrawal, cancellation or reimbursement.
A discount code may be limited to a specific account type, payment plan, period or number of uses. The reduced price and any restrictions are shown before ordering. Unless expressly stated otherwise, the displayed discount price becomes the fixed price of the payment agreement approved by the customer until it is cancelled. Discount codes cannot be exchanged for cash or applied retrospectively to an existing payment agreement.
5. Ordering and formation of the agreement
A free account is not itself a payment agreement. A payment agreement is only formed when the customer has selected a subscription, seen the total price and other material terms, submitted an order carrying an obligation to pay and received an electronic order confirmation.
The order confirmation, these terms and information about the right of withdrawal are sent to the supplied email address in a format that can be saved. If there is an obvious price or typographical error, we contact the customer without undue delay and do not complete the purchase on the incorrect basis.
6. Payment
Payments and recurring payment agreements are handled by Vipps MobilePay. The customer can use the payment methods displayed in Vipps MobilePay, for example MobilePay, Visa or Mastercard.
For a one-time payment, the approved amount is charged when the purchase is completed. Under an expressly approved recurring agreement, the subscription price is charged at the beginning of the paid period and subsequently on the stated payment date for each new period. A price cannot be charged automatically unless the customer has separately approved a recurring payment agreement.
Hjerterum does not store the customer’s full card details. Payment information is processed by Vipps MobilePay and any card or acquiring partners under their own terms and privacy policies.
If a payment is declined, the customer is notified and given a reasonable opportunity to update the payment method or pay another way. Access may be restricted if payment remains outstanding. The right to view, export or delete family data is retained as described in the app and privacy policy.
7. Delivery and access
Access is delivered digitally to the customer’s Hjerterum account. When purchased after a trial, paid access normally opens as soon as payment is registered.
If the customer purchases before the trial ends, the order summary states whether the paid period begins immediately or after the remaining free period. No payment is charged for a period described as free in the order.
8. Right of withdrawal
The customer has a 14-day right of withdrawal from the day the payment agreement is formed.
To withdraw, the customer must send an unambiguous statement to the email address above or use an online withdrawal function if one is available. The standard form at the end of these terms may be used but is not required. The deadline is met when the statement is sent before it expires.
If the customer expressly asked for the paid service to begin before the withdrawal period expired and later withdraws, we may only charge for the part already supplied where the statutory conditions are met. The amount is calculated proportionately from the agreed price and supplied period.
Following a valid withdrawal, received payments are reimbursed without undue delay and no later than 14 days after the statement is received. Reimbursement is normally made using the original payment method without a fee, less any lawful proportionate amount for service already supplied.
9. Duration, renewal and cancellation
The order summary states whether the agreement is fixed-term or ongoing, whether it renews automatically and, if so, when the next payment is due. A fixed-term agreement does not renew automatically unless the customer expressly approves this.
A monthly subscription can be cancelled at any time. Cancellation no later than the day before the displayed renewal date stops the next automatic renewal. If cancellation occurs later, a renewal already scheduled may be completed, and cancellation will then take effect at the end of the following paid monthly period.
An annual subscription sold as a fixed-term agreement without automatic renewal runs for the paid 12-month period and then ends without further payment. If the customer approved an automatically renewing annual subscription, cancellation no later than the day before the displayed renewal date stops the next renewal. A renewal already scheduled may be completed if cancellation occurs later, subject to the customer’s mandatory rights.
For an ongoing agreement, including an automatically renewed annual subscription, the customer may after five months cancel with one month’s notice to the end of a month in accordance with section 28 of the Danish Consumer Contracts Act. The same applies to a prepaid offer lasting more than 12 months. The part of the prepayment covering time after cancellation takes effect is reimbursed without undue delay. Any more favourable cancellation right shown at purchase also applies.
Cancellation is available in Hjerterum’s profile or subscription area and by written request to the email address above. Cancelling on the technical platform must be at least as easy as entering the agreement. The customer receives confirmation in a format that can be saved.
Deleting the app or not using it does not constitute cancellation.
10. Changes to prices and terms
The price does not change during a period already paid for. Changes affecting a later subscription period are communicated clearly and individually by email or another durable medium with reasonable notice.
For a material change to the customer’s disadvantage, we also state the change, effective date and right to cancel before it takes effect. Changes requiring a new agreement are only made with the customer’s consent.
11. Operations and changes to the service
Short interruptions may occur for maintenance, security, error correction or circumstances beyond our reasonable control. Planned maintenance is announced where practicable.
Hjerterum may be continually improved and changed. Updates, including necessary security updates, are supplied for the period required by the agreement and mandatory rules on digital services. Changes may not remove material agreed features without an objective reason and the notice or options required by law.
12. Customer responsibilities
The customer must provide correct contact and payment information, protect login credentials and ensure child profiles are used under adult responsibility. Hjerterum must not be used unlawfully, for abusive content, attempted unauthorised access or in a way that harms the service or other users.
13. Personal data
Processing of personal data, children’s information, deletion periods, processors and rights is described in the Hjerterum privacy policy. Options for account export and deletion are available in the family and data settings.
14. Defects and complaints
If Hjerterum is not supplied as agreed, the customer should contact us using the details above and describe the problem. We will attempt to remedy it within a reasonable period.
The customer’s rights concerning defects follow mandatory Danish rules on digital services. These terms do not restrict rights to remedy, proportionate reduction, termination or damages where the statutory conditions are met.
15. Liability
We are liable under the ordinary rules of Danish law. Nothing in these terms limits liability that cannot lawfully be limited or the customer’s mandatory consumer rights.
16. Complaints
Please contact us first at the email address above so that we can try to find a solution.
If no solution is found, a consumer may complain to the Danish Mediation Team for Consumer Complaints, Nævnenes Hus, Toldboden 2, 8800 Viborg, through naevneneshus.dk, provided the conditions for handling the complaint are met.
17. Governing law
The agreement is governed by Danish law. The customer does not lose protection provided by mandatory consumer rules in their country of residence.
